TCS case | Nida Khan subjected to a trial by media, says Owaisi

Nida Khan, a Muslim woman from Maharashtra, has become the center of a controversy after her estranged husband filed a rape case against her, alleging she concealed her previous marriage and religious conversion to Hinduism while marrying him. The case has drawn significant attention and criticism, particularly regarding the alleged media coverage.

Asaduddin Owaisi, president of the All India Majlis-e-Ittehadul Muslimeen (AIMIM), strongly condemned the handling of the case, stating Nida Khan was subjected to a “trial by media.” He argued that media outlets amplified the husband’s claims without verifying facts, portraying her negatively and fueling Islamophobia. Owaisi emphasized the importance of due process and the presumption of innocence.

The husband alleges Nida Khan was previously married and converted to Hinduism under the name ‘Divya’ before marrying him. He claims she concealed this information, constituting fraud and leading to the rape charge. Nida Khan, however, maintains her innocence and asserts she was forced to convert back to Islam by her family. She alleges her husband harassed her for dowry and subjected her to domestic violence.

The Bombay High Court has granted Nida Khan interim protection from arrest, directing the police not to take coercive action against her until the next hearing. The court acknowledged the sensitivity of the matter and the potential for misuse of legal proceedings.

Several women’s rights activists and organizations have also voiced concerns about the case, highlighting the potential for misuse of laws and the targeting of Muslim women. They argue the case reflects a pattern of harassment and discrimination faced by women who choose to marry outside their religion. The National Commission for Women has also taken cognizance of the matter and sought a report from the Maharashtra police.

The case is ongoing, and the court will continue to hear arguments from both sides. The controversy underscores the complexities surrounding religious conversion, personal laws, and the role of media in sensitive legal matters.
