Prosecution failed to establish ‘conspiracy’ to kill Sohrabuddin Sheikh: Bombay HC

The Bombay High Court acquitted 22 individuals, including several police officers, in the 2005 Sohrabuddin Sheikh alleged fake encounter case. The court found the prosecution failed to establish a criminal conspiracy to eliminate Sohrabuddin and his wife, Kauser Bi.

The core of the judgment rests on a lack of concrete evidence linking the accused to a pre-planned conspiracy. The court highlighted significant discrepancies and contradictions in the testimonies of crucial witnesses, many of whom were themselves implicated in the case and turned approvers. These inconsistencies cast doubt on the entire narrative presented by the prosecution.

Specifically, the court questioned the reliability of statements given by witnesses claiming to have overheard conversations about eliminating Sohrabuddin. It noted a lack of corroborating evidence and pointed to potential motivations for these witnesses to implicate the accused. The court also observed that the alleged meetings where the conspiracy was hatched were not adequately proven.

The judgment detailed failures in the investigation, including a lack of proper documentation and procedural lapses in collecting evidence. The court criticized the handling of the case by the Central Bureau of Investigation (CBI), suggesting a biased investigation influenced by political considerations.

The court acknowledged that Sohrabuddin was a criminal with several cases against him, but this did not justify a fabricated conspiracy or a fake encounter. The deaths of Sohrabuddin, Kauser Bi, and Tulsiram Prajapati (who was killed later in a separate encounter) were tragic, but the court maintained that the prosecution couldn’t prove these deaths were the result of a criminal conspiracy involving the accused.

Several high-ranking police officers were among those acquitted, including D.G. Vanzara, Rajinder Kumar, and Dinesh M.N. The court stated that while there might have been procedural errors or excesses committed by the police, these did not amount to criminal conspiracy. The acquittals effectively overturn the previous convictions and orders for further investigation in the case.
