‘Large-scale banking fraud’ involving Anil Ambani’s ADAG requires thorough probe, says SC

The Supreme Court has directed a thorough investigation into large-scale banking fraud allegedly perpetrated by Anil Ambani’s ADAG group companies, involving substantial public funds. The court was hearing petitions filed by SBI and other banks seeking directions for investigation and recovery of funds.

The alleged fraud centers around loans extended to Reliance Communications, Reliance Infrastructure, and other ADAG firms. Banks claim these companies diverted funds, manipulated accounts, and engaged in round-tripping of funds to falsely inflate their financial health and secure further loans.

The Court specifically highlighted concerns regarding the role of auditors who allegedly failed to detect or report the fraudulent activities. It questioned how these irregularities went unnoticed for so long and directed scrutiny of the audit process.

The bench expressed dissatisfaction with the existing investigation by the CBI, deeming it “too slow” and lacking in thoroughness. It ordered the CBI to conduct a comprehensive investigation, potentially involving a Special Investigation Team (SIT), to uncover the full extent of the fraud and identify all responsible parties.

The Court also directed the Enforcement Directorate (ED) to investigate the diversion of funds and potential money laundering activities. It emphasized the need to attach and recover assets acquired through illicit means.

The ADAG group has consistently denied the allegations, claiming they are victims of circumstances and that the loans were extended based on legitimate business plans. However, the Court has taken a serious view of the banks’ claims and the evidence presented.

The Supreme Court’s order aims to ensure accountability and recovery of public funds lost due to the alleged fraud. It signals a strong resolve to address financial crimes and protect the interests of banks and depositors. The investigation will likely focus on identifying the individuals and entities involved in the alleged conspiracy, tracing the flow of funds, and recovering the misappropriated amounts. The court has scheduled further hearings to monitor the progress of the investigation.
