The Supreme Court’s recent dismissal of petitions challenging the Andhra Pradesh government’s actions against Margadarsi Chit Fund Private Limited (MCFPL) has been welcomed by the YSR Congress Party (YSRCP). The core of the case revolved around allegations of fraudulent practices and misuse of funds by MCFPL, impacting small investors.
The Andhra Pradesh government, under Y.S. Jagan Mohan Reddy, had initiated investigations and issued orders freezing MCFPL’s bank accounts and attaching its properties in 2020, alleging that the chit fund had diverted approximately ₹3,700 crore from subscribers’ accounts to prop up its media ventures – Sakshi media group.
MCFPL contested these actions, arguing they were politically motivated and violated principles of natural justice. They claimed the government lacked sufficient evidence and that the actions were damaging to the company’s reputation and operations. Multiple petitions were filed in the High Court, which initially offered some relief to MCFPL, staying the government orders.
However, the Andhra Pradesh government appealed to the Supreme Court. The Supreme Court ultimately set aside the High Court’s orders, allowing the state government to proceed with its investigations and enforcement actions. The court observed that the High Court had interfered prematurely with the ongoing investigation.
YSRCP leaders have stated the Supreme Court’s decision validates the government’s claims of financial irregularities within MCFPL and its links to the Sakshi media group. They assert the government acted in the interest of protecting the savings of vulnerable investors.
MCFPL has expressed disappointment with the Supreme Court’s decision and maintains its innocence, stating it will continue to cooperate with the investigation and defend its position. The company argues the freezing of accounts and attachment of properties have caused significant hardship to its subscribers.
The case continues to be a politically sensitive issue in Andhra Pradesh, with the opposition parties alleging the YSRCP government is using state machinery to target businesses critical of it. The government maintains its actions are solely based on evidence of financial wrongdoing. The investigation is ongoing, and the future of MCFPL remains uncertain.
