HC directs PIL petitioner to represent to government over war memorial

The Telangana High Court directed a Public Interest Litigation (PIL) petitioner, advocate P.S. Sudhakar Reddy, to directly represent his concerns regarding the construction of a War Memorial to the State government. The court refrained from treating the PIL as formally admitted, suggesting the government is better positioned to address the issues raised.

Reddy’s PIL challenged the location chosen for the memorial – near Hussain Sagar lake in Hyderabad – citing potential environmental damage and concerns over the memorial’s design not adequately reflecting the sacrifices made by soldiers. He argued the location is a full tank level (FTL) area, impacting the lake’s ecosystem, and that the design prioritizes aesthetics over honoring the fallen.

The court acknowledged the sensitivity of the matter and the importance of honoring war veterans. However, it emphasized that the government is already actively involved in the project and has established a committee to oversee its construction.

Justice P. Naveen Rao and Justice M. Nageswara Rao suggested that the petitioner’s representations, including detailed objections to the design and location, would be more effectively considered by the government directly. The court directed the government to consider the petitioner’s representation and pass appropriate orders in accordance with the law.

The government, represented by Advocate General B.S. Prasad, informed the court that the committee includes retired military personnel and experts who are considering all aspects of the memorial’s construction. The Advocate General assured the court that the government is committed to constructing a befitting memorial.

The court further noted that the petitioner has the liberty to approach the court again if dissatisfied with the government’s response. The case was adjourned with no orders passed on the PIL’s admission, effectively shifting the responsibility for addressing the concerns to the government. The core issue remains the suitability of the Hussain Sagar location and the memorial’s design in adequately commemorating the sacrifices of soldiers.
