Supreme Court refuses to adjourn hearing on pleas against ECI law, says this matter is more important

The Supreme Court is proceeding with hearings on petitions challenging the recent amendments to the Election Commission of India (ECI) law, despite requests for adjournment. The court emphasized the matter’s importance, particularly with the upcoming Lok Sabha elections.

Several petitions argue the amendments, enacted in March, undermine the ECI’s independence. Key changes include a selection committee for Commissioners now comprising the Prime Minister, the Leader of Opposition, and a Union Cabinet Minister – removing the Chief Justice of India. Petitioners contend this alters the established constitutional scheme ensuring neutrality. They also challenge the removal process of Commissioners, arguing it lacks sufficient safeguards.

During the hearing, arguments centered on whether the amendments fundamentally alter the basic structure of the Constitution. Senior advocates representing petitioners highlighted the potential for political influence in the appointment and removal of Election Commissioners. The Attorney General defended the amendments, stating they aim to provide statutory backing to a process previously governed by convention. He argued the amendments enhance transparency and accountability.

The court questioned the rationale behind excluding the CJI from the selection committee, seeking clarification on the government’s intent. Justices expressed concern about the potential for executive dominance.

The ECI itself submitted an affidavit stating it has no objection to the court examining the constitutional validity of the amendments. However, it requested the court to defer hearing on specific aspects related to the removal of Commissioners until after the elections, citing operational concerns. The court rejected this request for deferral.

The next hearing is scheduled for May 8th, with the court directing the submission of further documents and arguments. The petitions seek a stay on the operation of the amended law, a request the court is currently considering alongside the constitutional challenges. The core issue remains whether the amendments compromise the ECI’s autonomy and the fairness of the electoral process.
