Bombay HC frees 50 stranded seafarers; raps vessel owners for treating crew worse than pets

The Bombay High Court has ordered the release of 50 seafarers stranded aboard the MV Whites Rose, severely criticizing the vessel owners, M/s White Rose Shipping Pvt. Ltd., for their inhumane treatment of the crew. The court likened the seafarers’ conditions to being “worse than pets,” highlighting prolonged periods without adequate food, water, and medical attention.

The seafarers, mostly Indian nationals, had been stuck on the ship since November 2023, initially due to a technical issue and later due to the owners’ financial difficulties and unwillingness to address the crew’s basic needs. Repeated pleas for repatriation were ignored. The court noted the owners displayed a “callous disregard” for the crew’s welfare, prioritizing the vessel’s maintenance over the fundamental rights of those working on it.

Justice Kamal Khata meticulously reviewed evidence including communication logs, crew lists, and affidavits, concluding the owners had failed to fulfill their statutory obligations under the Merchant Shipping Act and international conventions regarding seafarer welfare. The court specifically condemned the lack of provisions, forcing the crew to rely on charity from local fishermen and NGOs for sustenance. Medical supplies were also severely lacking, with reports of untreated illnesses.

The court directed the owners to cover the seafarers’ repatriation costs and unpaid wages. It also mandated a detailed report on the vessel’s condition and the reasons for the prolonged delay in addressing the crew’s concerns. The court further warned of potential criminal proceedings against the owners if they failed to comply with the orders.

The judge emphasized the importance of upholding the dignity and rights of seafarers, who contribute significantly to global trade. The ruling serves as a strong message to ship owners regarding their responsibilities towards their crew and the consequences of neglecting their welfare. The court’s intervention ensured the immediate release of the seafarers and initiated a process to secure their outstanding dues and safe return home.
