SC takes cognisance of resolution about HC judge sending advocate to custody

The Supreme Court has taken suo motu cognizance of a resolution passed by the Madras High Court regarding a judge sending an advocate to custody for allegedly misbehaving during court proceedings. Justice S.M. Shinde, representing the Chief Justice of India, issued notice to the Advocate General of Tamil Nadu and the contemner advocate, G. Rajendran.

The resolution, initiated by Justice Sundresh, highlighted the advocate’s disruptive behavior on March 1st, including raising slogans and refusing to adhere to court decorum. The judge had ordered Rajendran’s detention for several hours, citing interference with judicial proceedings. This action sparked protests from the Madras Bar Association, who passed the resolution condemning it as an overreach of authority.

The Supreme Court’s intervention stems from concerns raised about the potential transgression of the judge’s powers and the impact on the advocate’s fundamental rights. The court is examining whether the judge’s decision to order custody was justified and in accordance with established legal procedures.

The notice issued directs the Advocate General to explain the state’s position on the matter and the advocate to respond to the allegations. The court emphasized the need to balance maintaining judicial authority with safeguarding the rights of advocates.

The Madras High Court’s resolution detailed the advocate’s conduct, stating he repeatedly interrupted proceedings, used inappropriate language, and refused to comply with the judge’s directions. It also noted the advocate’s prior history of similar disruptive behavior.

The Supreme Court’s decision to intervene underscores the importance of due process and the need for a thorough examination of the circumstances surrounding the advocate’s detention. The case raises questions about the limits of a judge’s power to maintain order in the courtroom and the appropriate response to advocate misconduct. The matter is listed for further hearing next week.
