Karnataka High Court permits two transgender persons to continue hormone replacement therapy

The Karnataka High Court has allowed two transgender individuals to continue hormone replacement therapy (HRT) without requiring parental consent, overturning an earlier single-judge order. The petitioners, both over 18, had approached the court after facing obstacles in accessing HRT due to their parents’ refusal to consent.

The division bench comprising Justice C.V. Bhodanagoudar and Justice M. Nagaprasanna observed that adults have the right to make decisions regarding their own bodies and healthcare, and parental consent shouldn’t be a barrier when individuals are legally adults. The court emphasized the importance of self-determination and bodily autonomy, particularly for transgender persons.

The single-judge had initially directed the petitioners to obtain parental consent, citing medical guidelines. However, the division bench disagreed, stating that the medical guidelines cannot override the fundamental rights of adults. The court acknowledged the evolving understanding of gender identity and the medical necessity of HRT for many transgender individuals.

The court further noted that the petitioners had already undergone psychiatric evaluation and were deemed fit to undergo HRT by medical professionals. It highlighted that denying access to HRT could be detrimental to their mental and physical well-being.

The bench directed the medical authorities to ensure uninterrupted access to HRT for the petitioners, based on the recommendations of their treating doctors. The court also clarified that this order applies specifically to the two petitioners and doesn’t create a blanket rule for all transgender individuals seeking HRT. Each case will be evaluated on its own merits.

The ruling is seen as a significant step towards affirming the rights of transgender adults to healthcare and self-determination in India. It reinforces the principle that legal adulthood brings with it the right to make independent decisions about one’s own body and medical treatment, irrespective of familial consent.
