Madhya Pradesh court orders registration of FIR in Jabalpur boat tragedy that killed 13 people

A Madhya Pradesh court has directed the registration of a First Information Report (FIR) regarding the Jabalpur boat tragedy that occurred on January 21, 2024, resulting in the deaths of 13 people. The court acted on a petition filed by the families of the deceased, alleging negligence and criminal acts leading to the incident.

The Jabalpur High Court, specifically Justice Sanjay Dwivedi, ordered the Jabalpur police to register an FIR under Sections 304A (causing death by negligence), 308 (culpable homicide not amounting to murder), and 120B (criminal conspiracy) of the Indian Penal Code. The court also included relevant sections related to the Inland Vessels Act, 1917.

The petition highlighted several alleged irregularities, including the boat being overloaded, the absence of proper safety measures like life jackets, and the lack of a valid license for operating the boat. Petitioners argued that despite prior complaints regarding the boat’s condition and illegal operation, authorities failed to take adequate action.

The court noted that the initial investigation by the police appeared to be inadequate and focused solely on accidental deaths, overlooking potential criminal negligence. The judge expressed dissatisfaction with the police’s handling of the case and emphasized the need for a thorough investigation to determine responsibility and prevent future tragedies.

The FIR will now investigate the roles of the boat operator, local authorities responsible for overseeing river activities, and anyone else potentially involved in the negligence that led to the disaster. The court’s order aims to ensure a comprehensive investigation and accountability for the loss of life. The families of the victims have been seeking a thorough probe and justice for their loved ones. The next hearing is scheduled for February 29, 2024, where the police will be required to present the progress of the investigation.
